Is domestic surveillance legal?

Surveillance is the process of documenting what is going on in the world of an individual. A spouse (A legally married entity) is not violating 'Stalking' laws because it is assumed that one knows the other and gives each other the right to be anywhere they are.  A non-legal entity or unmarried couple may straddle a very fine line and one or the other may interpret their actions as 'Stalking'.   Stalking is a Federal Offense (Felony) and is not tolerated in most US jurisdictions.  Michigan law prohibits certain behavior from an individual which violates another's right to privacy and their ability to move about uninhibited and without intimidation or fear.   This is why it is best to hire a Private Investigator to perform this work on your behalf.


Generally 'Domestic' surveillance involves a 'couple' mutually agreeing to have the other in their life.  The major difference comes into play when the significant other has 'legal' ties to that person (I.E.  They own a home, they have children, their are marital assets etc.).  In these matters the courts frown on what is still considered

an illegal act.  That being the 'Act of Adultery'.   There are certain sanctions granted to the non-violating party if they end up divorcing and their assets are divided.

How many investigators are used on a domestic surveillance case?

The number of agents used depends on a number of factors. Basic surveillance on an individual being followed from home or an uncomplicated work situation can be conducted by one agent. More complicated scenarios, such as following someone from a high rise office building, or airport or hotel require an additional agent. Other factors in which we may recommend a second agent include fast and aggressive drivers and extra alert drivers who always watch the rear view mirror. Of course an additional agent increases the cost of surveillance, and this factor is also taken into consideration in arriving at your budget. For a proper frame of reference, consider the fact that no law enforcement agency would ever conduct surveillance with less than two cars and few do that. The more investigators, the less likely the chance of detection.  Another factor is that of tailing a subject on a busy highway.  It may be very easy to loose the subject if they suddenly make a turn or perhaps run a traffic light.   Yes, this can be frustrating on anyone's budget but it is a reality of life and is NOT television.  We have worked many a case where if we had not had a second vehicle our subject would have been long gone!   The other factor is that of not being 'spotted' by the subject.  Having the same vehicle 'always' around raises suspicions and if the subject realizes they're being followed they're not going to engage in the activity you have hired us to perform surveillance for.

What do I do once the spousal surveillance is set up?

Once the surveillance plan is in place it is important that you do not do anything to alert the subject of the investigation. Do not change your habits and do not ask too many questions about their activities.  In fact, we advise our clients that interfering in an investigation is cause for termination with the loss of any deposits already made including any current charges leading up to that point.  Our job is to move about undetected, un-noticed and unfettered by outside influences.   DO NOT

talk to your friends or loved ones about having hired a PI.   Word of mouth can taint any investigation because you don't know who you really can trust.   Please just take our word on this; You are better off pretending that nothing has changed and that in reality you are waiting for whatever results turn up.   Believe us when we tell you; the surveillance is but one aspect of an investigation.  When it comes to a head and you are faced with the truth, that's when you are going to need your wits about you because then you will really need to be strong.   We however cannot be involved in any such aftermath.  We will provide the evidence.  What you do with it is your business and we are not held legally accountable in any manner whatsoever.

Will the suspected cheating spouse find out that they are being watched?

Our surveillance investigations are 100% confidential. We do everything necessary to insure the covert nature of the investigation. If we ever perceive that the security of the investigation is threatened, we back off and re-evaluate with your input. One important point: Never threaten to hire an investigator. This will make the suspected cheater even more difficult to watch. If you have done this, be sure to tell us ahead of time so we can then act in a 'counter-surveillance' mode.  That is, as if "WE" were being watched.   Better to tell as few people as possible when playing the 'cloak and dagger' game.

What evidence will I receive at the conclusion?

The evidence collected in domestic surveillance consists of the videotape/DVD of the activities and a surveillance report which details all the activity in writing. Both are submitted to you.  There may be other forms of evidence including background checks, utility company checks etc.  This depends on the depth of the investigation. Agency Investigations LLC reserves the right to maintain all 'Originals' of any evidence secured.  This we must do by law and there are no exceptions.  However, any and all information is kept confidential and will never be disclosed to any non-authorized third-party entity.  The only exception to this rule is if the information obtained is subpoenaed by a court order to produce such evidence.
